The religious right has been protesting adding sexual orientation as a protected group in the hate crimes legislation citing, among other things, that the hate crimes bill would threaten the free speech rights of religions to condemn homosexuality.
To address these concerns, Senator Brownback added an amendment to the Senate version of the bill which protects religious expression. His amendment passed. Here, Senator Brownback explains the amendment:
The Senate version of the hate crimes legislation passed this week and is attached as an amendment on the defense authorization bill. That bill is must-pass legislation, but it has not passed yet, and when it does it will have to go to conference committee, where the hate crimes portion must be reconciled with the House version.
The House hate crimes bill, which has no amendment on religious speech, has already passed.
