Is Marriage Banned in Texas?


Barbara Ann Radnofsky, a Houston lawyer and Democratic candidate for Texas attorney general, says that the anti-gay marriage amendment passed in 2005 in Texas effectively eliminates all marriage in the state. The language at issue reads:

This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage.
